Probate With A Will

When one dies leaving a provable Last Will and Testament, the submission of the Last Will and Testament for probate will be required. The document must be filed in the Texas county where the deceased person was domiciled or had a fixed place of residence, or as otherwise provided for in the Texas Estate Code.

Upon filing the Last Will and Testament for admission to probate, a hearing will take place in due time and order where proof will be presented to and accepted by the probate court for admission, and to appoint the executor or executrix of the estate, who will perform three basic duties:

  1. collect and account for the estate property;
  2. pay the outstanding and authenticated debts, taxes, and expenses of the deceased person and estate; and,
  3. distribute the net estate to the ones named to receive the bequests and gifts under the Last Will and Testament.
